1. Introduction
Welcome to Optymatch.ai ("Optymatch", "we", "our", "us"), a cloud-based recruitment software platform owned and operated by Acclivity Software Pvt. Ltd. (the "Company"). These Terms & Conditions ("Terms") govern your access to and use of the Optymatch website, platform, applications, integrations, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
Platform Domains: Optymatch is accessible via optymatch.ai and optymatch.com, both of which refer to the same platform and services operated by Acclivity Software Pvt. Ltd. The Optymatch application is hosted at app.optymatch.com.
2. Acceptance of Terms
By creating an account, starting a free trial, or purchasing a subscription, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and any plan-specific terms communicated to you.
3. Definitions
- User / Customer: Any individual or entity accessing or using the Service.
- Account: A registered Optymatch account created by a User.
- Content: Any resumes, job descriptions, candidate data, documents, communications, or information uploaded to the platform.
- Subscription Plan: A paid plan that provides access to specific features and usage limits.
4. Account Registration & Responsibilities
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your login credentials.
- All activities conducted through your account are your responsibility.
- You must immediately notify Optymatch of any unauthorized access or security breach.
5. License & Permitted Use
Optymatch grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for legitimate recruitment and hiring purposes, in accordance with your selected plan and these Terms.
You may not:
- Copy, modify, reverse engineer, or resell the Service.
- Use the Service for unlawful, deceptive, or abusive activities.
- Circumvent usage limits or security controls.
6. Subscription Plans, Pricing & Free Trial
- Optymatch pricing and plan details are available at https://optymatch.ai/pricing.
- Paid plans currently start as low as INR 1,250 or USD 15 per seat per month, subject to change.
- Optymatch offers a 7-day free trial, which includes 1 job post, 1 job match, and up to 20 resume uploads.
- All subscription fees are payable in advance and are non-refundable unless expressly stated otherwise.
- Failure to renew or make timely payment may result in suspension or termination of access.
7. Data Ownership & Use of Content
7.1 Customer Data Ownership
You retain full ownership of all resumes, job descriptions, candidate information, and other Content uploaded to the platform.
7.2 License to Process Data
By using Optymatch, you grant us a limited license to store, process, analyze, and use your Content solely for:
- Providing and improving the Service
- Enabling matching, screening, analytics, and automation features
7.3 AI Model Training (Anonymized)
You expressly consent that the textual content of resumes and job descriptions may be used to improve and train Optymatch's AI models only in an anonymized and aggregated manner.
- No personally identifiable candidate information is used for AI training.
- Uploaded files, candidate identities, and customer-specific data are not shared externally.
- No data is sold, licensed, or transferred to third parties for training or commercial purposes.
8. Data Security & Infrastructure
- Optymatch and its databases are hosted on industry-leading infrastructure providers, with enterprise-grade security controls.
- Data is stored and processed only on secured servers selected by Optymatch.
- We do not store customer data outside our controlled infrastructure or transmit it to third parties without consent.
- While we follow industry best practices, absolute security cannot be guaranteed.
9. Third-Party Integrations
Optymatch supports integrations with third-party services such as Google Calendar, Outlook, and email providers.
- Use of these integrations is subject to the respective third-party terms and policies.
- Optymatch accesses these services only via authorized APIs and only to enable requested functionality.
- Optymatch is not responsible for outages, data handling, or policy changes of third-party providers.
10. Service Availability & Changes
- Optymatch strives to maintain high service availability but does not guarantee uninterrupted access.
- Scheduled maintenance or upgrades may cause temporary disruptions.
- We may add, modify, or discontinue features, plans, or pricing with reasonable notice.
11. Support
Support levels depend on your subscription plan. This may include onboarding assistance, email support, and business-hours support as specified in your plan details.
12. Intellectual Property
- All intellectual property rights in the Optymatch platform, including software, algorithms, interfaces, branding, and documentation, remain the exclusive property of Acclivity Software Pvt. Ltd.
- Customer logos and names may be used for reference purposes unless you opt out in writing.
13. Confidentiality & NDAs
Optymatch treats customer data as confidential. NDAs may be executed upon request for enterprise or agency clients.
14. Termination
- You may terminate your subscription at any time. No refunds will be provided for unused periods as infrastructure is allocated and paid for at the time of account set up.
- Optymatch may suspend or terminate access for non-payment, misuse, or violation of these Terms.
- Upon termination, data may be deleted in accordance with our data retention practices.
- Customers can download data backups from the backups tab in the account settings tab.
15. Warranties & Disclaimers
The Service is provided on an "as is" and "as available" basis. Optymatch disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted service.
16. Limitation of Liability
To the maximum extent permitted by law:
- Optymatch shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business.
- Optymatch's total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
17. Indemnification
You agree to indemnify and hold harmless Optymatch and its affiliates from any claims, losses, or damages arising from your use of the Service or violation of these Terms.
18. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
19. Amendments
Optymatch may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
